1. About These Terms
These Terms and Conditions ("Terms") govern your access to and use of the services provided by Greenalp ("we", "us", "our"), including the Greenalp websites at https://www.greenalp.com and https://www.track4business.com, and the Android applications "Real Time GPS Tracker" and "Real Time GPS Tracker 2" (together, the "Services").
By accessing or using any of the Services, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, you must not access or use the Services. You are responsible for ensuring that your use of the Services complies with all laws that apply to you.
2. The Services
The Services are intended for personal and informational use. We may add, modify, suspend or discontinue any part of the Services at any time, with or without prior notice.
The Services are operated from Austria; our server is located in Germany. While the Services may be accessed from other countries, you acknowledge that they:
- are not designed or customised for any particular country or jurisdiction;
- are not intended for use by any person in any territory where such use would be contrary to local law or regulation; and
- may not be appropriate or available in every territory.
You access and use the Services on your own initiative and are solely responsible for complying with the laws that apply where you are located. If you download an application from the Google Play Store, your use is also subject to Google Play's Terms of Service.
3. Electronic Communications
You agree that we may provide notices and other communications to you electronically, and that such communications satisfy any legal requirement that they be made in writing. If you do not wish to receive communications electronically, your only remedy is to discontinue your use of the Services.
4. Privacy and Data Protection
The Services involve the collection and processing of personal data, including location data. We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable Austrian data protection law, as described in our Privacy Policy. Your use of the Services confirms that you have read and understood the Privacy Policy, which is available on the Greenalp website.
5. Acceptable Use
You may use the Services for lawful purposes only. In particular, you must not use the Greenalp tracking applications to locate or monitor any person without their knowledge and consent, including for surveillance, stalking or any other covert or unlawful purpose. You are solely responsible for obtaining any consent required by law before tracking or sharing the location of any individual.
6. Disclaimer of Warranties
To the fullest extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the Services will be uninterrupted, timely, secure or error-free, or that any information provided through them (including location data) is accurate, complete or reliable.
Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under the law applicable to you, including any mandatory statutory rights you may have as a consumer.
7. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, special, incidental, consequential or exemplary damages, or for any loss of profits, goodwill, data or business, arising out of or relating to your use of, or inability to use, the Services.
Subject to the paragraph below, our total aggregate liability arising out of or relating to these Terms or the Services shall not exceed one hundred euros (EUR 100).
Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit); or (d) any other liability that cannot be excluded or limited under applicable law.
8. Governing Law and Jurisdiction
These Terms, and any dispute arising out of or in connection with them, are governed by the laws of Austria, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.
The courts of Vienna, Austria shall have jurisdiction over any dispute, subject to the following: if you are a consumer resident in the European Union, you benefit from the mandatory consumer protection provisions of the country in which you reside, nothing in these Terms affects those rights, and any dispute may also be brought before the competent courts of your place of residence where applicable law so requires.
9. Severability and Entire Agreement
These Terms, together with the Privacy Policy and any additional terms or guidelines published on the Greenalp website, constitute the entire agreement between you and us regarding the Services and supersede all previous written or oral agreements. If any provision of these Terms is held to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable while reflecting the original intent, and the remaining provisions shall remain in full force and effect.
10. Changes to These Terms
We may revise these Terms from time to time without prior notice. The current version will always be available on the Greenalp website. Your continued use of the Services after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the changes, your only recourse is to stop using the Services.
11. Termination
Your right to use the Services terminates automatically if you breach these Terms. We may also suspend or terminate your access to all or part of the Services at any time, with or without notice, where we have a legitimate reason to do so (for example, to comply with the law, to protect the Services or other users, or following a breach of these Terms).
